Reimbursement to rightholders of the value of the seized immovable property and (or) losses caused by its withdrawal

Amount of support

Reimbursement in the amount of the cost of restoration work or the cost of work necessary to preserve the seized property, but not more than the amount received as a result of bidding, less cash in the amount of expenses for conducting public bidding (including the cost of preparing a report on the assessment of market value), as well as the cost of restoration work or the cost of measures necessary to preserve the seized property.

As a result, the buyer of the cultural heritage object pays only for the costs of conducting public bidding. (Expenses for public bidding - estimation of the market value of the OKN and the cost of restoration works of the OKN, as well as VAT).

Reparation mechanism

1. The court decided to withdraw the object through sale from public auction.
2. The Ministry of Property Relations of the Yaroslavl Region (MIO YaO) announces an open auction.
The initial auction price = the market value of the seized OKN (including VAT), determined on the basis of the market value assessment report.
3. According to the results of the auction, a contract for the purchase and sale of the object is concluded, the buyer transfers the cost of the seized property in full to MIA NSC (including VAT).
4. Upon receipt of the EGRN statement on the acquired property from the buyer, IO NW transfers funds to the account of the winner of the auction in the amount of the cost of restoration work or the cost of work necessary to preserve the seized property, but not more than the amount received as a result of the bidding, minus the money in the amount of public bidding costs (including the cost of writing a market value assessment report), as well as the cost of restoration work or the cost of measures necessary to preserve the seized property.

Almost always, the cost of restoration of OKNs exceeds the market value of OKNs.
