The State has adopted a federal law on the development of creative industries
The State Duma reviewed and adopted the federal law on the development of creative industries in the Russian Federation on second and third reading. It is co-sponsored by the Chairman of the Committee of the State Duma on Economic Policy, Maxim Topilin, and the First Prime Minister of the Committee, Denis Kravchenko, a number of other deputies, as well as senators, with the active participation of the Agency in strategic initiatives.
The work on the law is being carried out as part of the mandate given by the President of Russia following his visit to the exhibition " Creative economy in Russia " organized on 30 May 2023 at the initiative of ASI.
The FZ embodies a number of key concepts in the creative economy. The Act is primarily aimed at creating conditions for systemic measures to support creative business.
A separate chapter is addressed in the draft support measures. Financial, property, education, information measures are provided. Conditions are also being created for the development of infrastructure for creative industries, which include creative clusters, information systems, property, creative industries and other forms.
More than 10 federal laws in Russia now regulate certain creative industries. These include cinema, information technology, architecture, industrial design, etc., and their regulation is distributed among a number of public authorities. This has led to some salmon in the regulation and management of creative economies in general. The law addresses this issue.
" This is part of the Agency ' s systemic work of strategic initiatives to develop the creative economy that we have been undertaking in recent years. Coordinated work with deputies, the Government and the creative community has led to the preparation of a law that allows for the development of creative industries in the complex, while allowing regional authorities to provide support to those areas that need it first. Together with the implementation of a regional standard for the development of creative industries, we are implementing a presidential mandate that ultimately contributes to the achievement of the national objective of a sustainable and dynamic economy, the Director-General of ASI, Svetlan Chupsev.
By second reading, the law had been substantially improved.
The key difference in the new wording of the law is to broaden the regional competence to develop creative industries, taking into account regional specificities, to define criteria for the inclusion of creative industries in accordance with regional legal instruments. The register of creative industries will form regions and the responsible FOIB will maintain a single federal register of creative industries.
" The creative industry is becoming a separate sector of the country ' s economy and is now seen as a powerful tool that can be a major driver of its development. There had been no systemic support for creative industries since there were no relevant concepts in federal legislation. Optics have changed now, now we're talking about business support, investment, direct and indirect economic impacts and exports to creative industries. The law is a framework law, and it gives very much flexibility and industry and regions. The Regional Standard for Creative (Creative) Industries, developed by ASI, will be the main instrument for the application of the federal law in the regions, which has already been implemented by 45 regions. We believe that regions that adopt best practices and approaches in this field will be able to earn a creative economy, and by introducing support measures, infrastructure, education, creating an enabling environment, entrepreneurs will be able to implement their projects and build a talented, non-experienced economy in Russia, the Director of the Creative Economy Development Centre, ASI Ekaterina Cerques-zade.
Compared with the first reading, a new definition of creative cluster had emerged; a new version of the law had also introduced a provision that Russia would assess the contribution of the creative economy to the Russian economy in accordance with its approved methodology.
The Act stipulates that the Government of the Russian Federation will determine the federal executive branch responsible for the formulation of public policy and regulatory functions in the creative economy. Such an EIF would be responsible for regulating not individual creative industries but the whole creative economy.
In addition to the second reading, important clarifications were made to the list of creative industries. Given the active development of creative industries and the emergence of new activities in this field, an open list has been established which allows for the inclusion of various activities and creative industries that are not explicitly referred to in the law. For example, according to the FZ, there are four large species of creative industries:
An industry based on historical and cultural heritage;
Industry based on literature and art, publications and performance;
Information and telecommunications industry;
an industry based on the application of creative activities.
People ' s arts and handicrafts, for example, include, among other creative industries and activities, the historical and cultural heritage industry. In this context, for example, industries based on historical and cultural heritage may include a wide range of creative industries and activities that are not explicitly named in the FZ. A direct list of the economic activities in the creative industries will be provided by the responsible EEO codes.
In line with the FA adopted, the Agency will work with the relevant agencies and the professional community to develop by-laws, implement the Standard in entities and other key projects.
" The adoption of a federal law on creative industries is an important and long-awaited development not only for creative industries as legal entities and beneficiaries of public support measures. In my view, the adoption of a separate federal law with a self-regulatory subject to special laws on certain types of creative industries is interesting in terms of legislative policy. In the case of different federal laws governing similar public relations, the legislature uses a tool for codifying or systematizing legislation. In the same case, the law does not purport to reassemble the regulation of certain types of industry, but rather to define common development instruments for all.
