The Government has simplified the procedure for submitting notifications on the start of business activities

Today, on April 1, 2024, certain provisions of the Federal Law came into force, establishing a new procedure for businessmen to notify about the start of entrepreneurial activity. 

In pursuance of this law, the Ministry of Economic Development of the Russian Federation has developed a draft resolution, which was approved by the Government.   According to the law, entrepreneurs (legal entities, individual entrepreneurs) can notify control (supervisory) authorities about the start of their business without leaving home - through the portal "Public Services". 

A unified electronic register has been created to systematize and account for such notifications. For some types of activities, you no longer need to submit notifications. For example, this applies to services in the field of photography, repair and maintenance of household electronic equipment, computers, telecommunications equipment, custom shoe manufacturing, shoe repair, etc. 

In total, more than 20 types of activities have been excluded from the list of mandatory notification, including on the initiative of the control departments themselves. Also, notifications will not be needed if stricter regulation is applied to a particular type of activity, for example, licenses are required. 

In particular, licensed services for the operation of explosive and chemically hazardous production facilities of hazard class IV are excluded from the list. Previously, a legal entity or an individual entrepreneur sent a notification of the start of entrepreneurial activity to a control (supervisory) body in paper form, either by registered mail or in electronic form, signing the document with an enhanced qualified electronic signature. Each department created and maintained its own register of notifications and posted it on its website. 

"The new notification procedure is another Government measure aimed at supporting the business community and reducing the administrative burden. One of the effective tools for this support is the digitalization of services. Many of them have already been converted to electronic form, for example, pre-trial appeals in the field of control and licensing activities, obtaining licenses and permits. Now another popular service is available in electronic form, which will save entrepreneurs from bureaucracy, save them time and effort," said State Secretary - Deputy Minister of Economic Development of Russia Alexey Khersontsev.  

  "Despite external constraints, economic growth in the country has significantly exceeded all expectations by the end of 2023. This is the result of the joint efforts of business and government. The proposed new resolution is another step towards facilitating conditions for private initiative, an opportunity for businesses to save time and effort. From the multitude of such decisions, confidence arises in further improving the efficiency of the economy, and, therefore, continuing rapid economic growth," said Boris Kopeikin, First Deputy Director General of the CSR. 

"For business, the legislative changes that came into force on April 1 this year are a logical continuation of the transfer of interaction with government authorities to a digital format through a single portal of public services. It also looks absolutely logical to create a Single register of notifications as part of a single register of types of control. You can only welcome if notifications about changes and termination of certain types of activities, about the reorganization of a legal entity are included automatically on the basis of changes in the Unified State Register of Legal Entities, the Unified State Register of Legal Entities. Such a format of interaction presupposes a certain level of technical equipment, the presence of an organization's profile on the public services portal and an enhanced qualified digital signature. With the current development of the level of use of digital technologies by businesses, this will not be a significant problem," explained the Expert Center for Control and Supervisory Activities of Delovaya Rossiya.
